Terms of Service

These Terms and Conditions ("Terms") govern your access to and use of the Scan by DAV canine visual wellness screening platform at scan.dialavet.com (the "Service"), operated by Dial A Vet Pty Ltd (ABN 23 657 754 375) trading as Scan by DAV ("we", "us", "our").

By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

References to "Scan by DAV" throughout these Terms refer to Dial A Vet Pty Ltd until such time as Scan by DAV is transferred to a separate legal entity, at which point these Terms will be updated accordingly.

1. Nature of the Service

1.1 Visual Screening Tool Only

Scan by DAV is a visual wellness screening tool that analyses photographs of dogs to generate observational indicators. It is not a diagnostic service, and it does not provide veterinary advice, diagnoses, prognoses, or treatment recommendations.

The Scan Score and tiered wellness indicators generated by the Service are based solely on visual analysis of the photographs you submit. They do not reflect internal organ function, systemic health, or any condition that cannot be observed visually.

1.2 Not a Substitute for Veterinary Care

The Service is not a substitute for professional veterinary examination, diagnosis, or treatment. You should not delay seeking veterinary care, or make decisions about your pet's health, based solely on the results generated by the Service.

If your pet is in pain, distress, or you believe your pet may have a serious health condition, contact a licensed veterinarian or emergency animal clinic immediately.

1.3 Telehealth Consultations

Where the Service facilitates access to telehealth consultations, those consultations are provided under licence by Dial A Vet Pty Ltd, a licensed veterinary telehealth platform. Telehealth consultations are subject to applicable veterinary practice regulations and may not include diagnosis or prescription where a valid Veterinarian-Client-Patient Relationship (VCPR) does not exist.

2. Eligibility and Account Registration

  • You must be at least 18 years of age to use the Service
  • You must provide accurate and complete information when creating an account or submitting a scan
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorised access to your account
  • We reserve the right to suspend or terminate accounts that breach these Terms

3. Acceptable Use

You agree not to:

  • Submit photographs of animals other than domestic dogs unless expressly permitted
  • Submit photographs containing persons in a manner that violates their privacy
  • Attempt to reverse-engineer, decompile, or extract the underlying model or algorithms
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Resell, sublicense, or commercially exploit the Service or its outputs without prior written consent
  • Introduce malicious code, viruses, or disruptive elements into the Service
  • Use automated tools, scrapers, or bots to access the Service without our written consent

4. Intellectual Property

4.1 Our IP

All intellectual property in the Service — including the Scan by DAV brand, computer vision models, algorithms, report formats, software, and content — is owned by or licensed to Dial A Vet Pty Ltd. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

4.2 Your Content

You retain ownership of the photographs you submit. By submitting photographs to the Service, you grant us a worldwide, royalty-free, perpetual licence to use, process, and store those photographs for the purposes described in our Privacy Policy, including anonymisation and incorporation into our Research Database.

4.3 Report Output

Your Scan Score and report are generated for your personal, non-commercial use only. You may share your report for personal purposes but may not reproduce, republish, or commercialise it without our prior written consent.

5. Payments and Pricing

  • All prices are displayed in USD unless otherwise stated
  • Payment is processed securely by Stripe, our PCI-DSS Level 1 compliant payment processor
  • You authorise us to charge your selected payment method for the amount displayed at checkout
  • All sales are final subject to our Refund Policy below and your statutory rights under applicable consumer law
  • We reserve the right to change pricing at any time; changes will not affect existing purchases

6. Refund Policy

6.1 General Rule — No Refunds on Delivered Reports

Because the Service delivers a digital report instantly upon payment, we do not offer refunds once your Scan Score and report have been generated and delivered to you. By proceeding to payment you acknowledge that the report will be delivered immediately and that your right of withdrawal under applicable consumer laws is waived upon delivery of the digital content.

6.2 Exceptions

We will provide a full refund in the following circumstances:

  • Technical failure — your scan failed to process, or your report was not delivered due to a technical error on our end
  • Duplicate charge — you were charged more than once for the same scan
  • Service unavailability — the Service was unavailable for an extended period immediately following your payment, preventing delivery

6.3 How to Request a Refund

To request a refund, email support@dialavet.com.au within 7 days of your purchase. Include your account email address, the date of purchase, and a description of the issue. We will respond within 2 business days and, where a refund is approved, process it within 5–10 business days to your original payment method.

6.4 Australian Consumer Law

Nothing in this Refund Policy limits or excludes your rights under the Australian Consumer Law (ACL) or any other applicable consumer protection legislation. If the Service fails to meet a consumer guarantee under the ACL, you may be entitled to a remedy regardless of this policy.

7. Disclaimers and Limitation of Liability

7.1 No Warranty

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the Service or its outputs.

In particular, we do not warrant that the Scan Score or wellness indicators are accurate, complete, or free from error, or that they will detect any particular health condition in your pet.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, Dial A Vet Pty Ltd's total liability to you for any claim arising out of or in connection with the Service shall not exceed the amount you paid for the specific scan giving rise to the claim.

We are not liable for any indirect, consequential, incidental, special, or punitive damages arising from your use of the Service, including but not limited to decisions made about your pet's health based on the Service's outputs.

7.3 Indemnity

You agree to indemnify and hold harmless Scan by DAV, its officers, employees, and sub-contractors from and against any claims, damages, losses, and expenses arising from your use of the Service in breach of these Terms.

8. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available at scan.dialavet.com/privacy. By using the Service, you consent to the practices described in the Privacy Policy.

9. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Zoom/Calendly (telehealth scheduling), and WhatsApp (triage messaging). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the conduct or content of third-party services.

10. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We may update these Terms from time to time. Material changes will be notified by email and posted here with a revised "Last updated" date at least 14 days before taking effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

We encourage you to contact us first at support@dialavet.com.au to resolve any dispute informally before commencing formal proceedings.

12. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us with respect to the Service.
